Construction
Bevan Brittan’s Construction Department is at the
forefront of working with public sector
organisations to develop innovative forms of
contract and standardised contract documentation. We
advise throughout the public sector on powers and
issues relating to CPO, particularly in the context
of major developments and regeneration projects.
We can advise on the use of standard or bespoke
contracts for specific projects and the implications
of risk allocation and management under the relevant
documents. We can help agree contracts and
sub-contracts and negotiate loss claims. Whenever
defects or claims occur, we will quickly provide a
comprehensive, practical and cost effective response
which could include negotiation, Alternative Dispute
Resolution (including Mediation), adjudication,
arbitration or litigation, ensuring control remains
firmly in your hands.
Recent projects include:

Assisting VOSA in setting up term contract
arrangements for the engagement of a single
contractor and a single team of consultants who
would be available over four-year periods to carry
out all necessary design, construction and testing
of individual Vehicle Testing Centres.

We have advised the Gwent Healthcare NHS Trust in
relation to the new Caerphilly and Ebbw Vale
Hospitals Project. Work included the construction
procurement, in particular, on how the new PPP
arrangements will work and how they will differ from
the more traditional construction approaches usually
adopted by the Trust. We have also advised on the
contractual arrangements (outside the PPP
arrangements) for carrying out remedial and other
preparatory works in order to be able to proceed
with the detailed design and construction of the new
hospital on a clear and remediated site.
