Due to the knowledge that we have in environmental law Bevan Brittan are able to assist their clients with procurement and negotiating contracts for waste disposal. We are able to advise on the meaning of "waste" and the practical requirements of the duty of care. When dealing with environmental law we will advise on waste management and licensing, on The Landfill Directive and its practical impact and on the landfill tax. We are able to advise on the relationship between waste disposal and town and country planning, both for local authorities and the private sector. David Wood deals with environmental law and he says that if he could change one law it would be The Commons Registration Act 1965 because it was intended to be a half of a regulatory scheme for the registration and management of common land and town and village greens which is a subject in environmental law that is close to his heart. The Act deals with the registration but not the management. Additionally the Act is being used to achieve objectives outside its remit ie where objectors fail to prevent the grant of planning permission they then apply for the registration of the land as a town or village green which at the least can delay development by two years or more.I have one case where objectors have attempted to stop the building of a new hospital on a vacant site acquired many years ago for just that purpose. The applications have been ongoing for about five years so far!.
