My background
Articled Clifford Turner; qualified 1983. 22 years’ post
qualification experience, including ten years in two major
City firms. Three years out of the profession working as a
financial public relations consultant. Joined Bevan Ashford
as a partner in 2000. Partner, Bevan Brittan LLP 2004.
What I do
I advise on contractual and commercial matters in the
field of health and social care with a particular focus on
contracting, partnerships between the public sector and the
independent sector and joint working between health and
social services. I also advise on a range of administrative
law issues including constitutional issues for Foundation
Trusts. I am the Head of our Out of Hospital Care Sector.
Some examples
I have advised both the private sector and the public
sector on a variety of issues in relation to the
commissioning of new community and primary care services
including the role of practice based commissioning, and
negotiating contractual arrangements for the operation of
primary care practices, prison health services, sexual
health services and home health care services.
I have been advising a number of NHS Trusts on their
development to Foundation Trust status and the use of their
flexibilities as Foundation Trusts. This includes advising a
Foundation Trust on the establishment of an overseas
subsidiary and on a range of joint ventures. I also
regularly advise on the legally binding contracts between
PCTs and Foundation Trust.
I have acted as lead partner on three closed NHS LIFTs –
East London NHS LIFT, West London NHS LIFT and South West
London NHS LIFT. The East London LIFT was the first NHS LIFT
in the country to close and involved much innovative
developmental work
I advised a local authority and PCT on the procurement of a
PPP for the development of a new care home and the operation
of an existing care home by a private sector partner. The
PCT and local authority entered into an agreement under
Section 31 of the Health Act 1999 giving lead commissioning
responsibility to the Council and establishing pooled
budgets.
