My Background
Having trained in London and qualified in a commercial firm, I joined the Government Legal Service in the early 1990s specialising in state aids; grants and economic development initiatives in Wales before joining Government Communications Headquarters (GCHQ) as deputy legal adviser. In 2005 I joined the Treasury Solicitor’s department where I led the Commercial Team before joining Bevan Brittan LLP in 2008 as a partner.

What I do
I am Head of the Procurement State Aids and Competition Team and Sector Head for the firm’s Central Government practice.

I advise on EU and UK Procurement law and practice, helping clients devise cost-effective, robust, commercial arrangements between the public and private sectors, whilst taking proper account of the contract award procedures and other legal constraints.

I provide specialist procurement support to the firm’s project and programme teams drawing on my experience of central government programmes and other commercial work for the public sector and I co-ordinate the team’s wider resources to provide an effective procurement, state aids and competition service to clients including defending (and from time to time challenging) decisions of public bodies.

I also have experience of advising on formal legal risk-management and on governance in a range of public bodies. I have a special interest in public/administrative law especially as it impacts commercial contracts; I also maintain an interest in the law relating to information assurance.

Some examples

  • At GCHQ I led for the agency’s in-house legal team in relation to the award –winning £1.2 billion New Accommodation PFI programme in Cheltenham (the so-called ‘doughnut’), an early, complex and innovative PFI project with unique security sensitivities;
  • Obtaining an ad hoc State Aid approval for substantial grant aid for a large inward investment project in South Wales;
  • Advising (at board level), a central government IT assurance delivery programme;
    Advising the Cabinet Office on public law and commercial aspects of its Shared Services agenda;
  • Leading on public law aspects of the Cabinet office’s ICT ‘Flex’ Framework Agreement;
  • Advising HM Prison Service on a contract for the transfer of healthcare services in a London Prison;
  • Devising and implementing a number of procurement strategies for public bodies, including utilisation of exemptions from the procurement regime;
  • Advising a major central purchasing body on the structure of its framework agreements and call-off contracts; the use of Lots; the effect of the Freedom of Information Act on procurements; Part B services and other aspects of the procurement regime;
  • Advising on the use of the competitive dialogue award procedure; below threshold procurements and the ‘in-house contract’ exception.
  • Advising government agencies on the successful exploitation of IPR and other valuable know-how.
