Commercial/Projects and PFI
Head of Division
Stephen is one of the leading regional PFI advisors,
according to Legal Business magazine.
Credited with having an "incredible brain," Private sector clients particularly value "his huge knowledge of the reforms and the NHS." Chambers UK, A Client’s Guide to the Legal Profession 2006
My
background
I had a previous career as a professional photographer
before retraining in law. I then joined Bevan Ashford in
1988 and became a partner in 1993. I have been a Partner
with Bevan Brittan LLP since the demerger in 2004.
What I do
I am head of the Health Division at Bevan Brittan and I sit
on the firm’s Executive Board. I am a recognised expert on
PPP and PFI. I am listed in all major directories, including
Legal 500, Chambers, Legal Experts as well as Chambers
Global. I specialise in the health sector, working for both
public and private sector clients.
Some examples
As well as working on some of the largest hospital projects
nationally, I also work internationally. A recent example is
an award winning scheme for a new hospital in Vancouver,
Canada. I also led the team that advised Partnerships for
Health and Partnerships UK on NHS LIFT.
The health
practice accounts for 35% of the firm’s revenue. This is a
market that is changing rapidly and radically: moving
towards pluralism with exciting opportunities for the
independent sector and those NHS Trusts which have the
ambition to respond to this new landscape. Bevan Brittan has
been at the vanguard of these changes and is the premier law
firm in the UK in the health market. My involvement has
extended to:
·
Acting for private sector
bidders on all major DH contracts (Wave 1 and 2 ISTC, GSup
2, NHS Decontamination, APMS etc);
·
assisting Acute Trusts to move to
Foundation Trust status and helping them to position
themselves as major independent mutual providers of
healthcare;
·
structuring innovative off balance
sheet products for Foundation Trusts as alternatives to PFI;
·
working on new partnership
collaborative contracts – sustainable commissioning;
·
creation of joint ventures between
Foundation Trust and the Independent Sector (we are
currently working on 11 from back office function through to
pharmacy, pathology, franchising, intermediate care and an
ophthalmology joint venture in the Middle East)
·
helping new entrants (mainly US)
to establish their strategic positioning in the UK market
and how to engage (successfully!) in major outsourcing
contracts subject to OJEU Rules;
·
new models of out of hospital
delivery: Practice Based Commissioning; corporatisation of
the GP market; APMS; Social Enterprise Foundation Trusts –
for companies as diverse as Clinovia, Harmoni CPO, Ashley
House, Ryhurst, Nuffield and United Healthcare.
