We have wide experience of supporting our clients through restructuring programmes. This ranges from small-scale redundancy initiatives up to more complex restructuring of large workforces.
We regularly play an integral role in the restructuring exercise. Typically this involves working with our client at the design stage, helping to avoid legal and tactical pitfalls and planning the procedural stages that will be followed. Often this includes working up a timeline and preparing the relevant documents for use at the stages leading up to any dismissals.
We have advised on many collective consultations, both for redundancy situations and for wholesale changes of terms and conditions. In respect of our public sector clients, in particular, we have a wealth of experience in assisting clients through national reforms and change programmes and the challenges that have arisen from them, such as Valuing People Now, Transforming Community Services, the ongoing Health and Social Care reforms and organisational change in response to the Comprehensive Spending Review.
Unfortunately, any large redundancy exercise carries the risk of legal challenge from unions or employee representatives and potentially tribunal claims. We have extensive experience in successfully defending such claims.
