We regularly provide advice on the negotiation and drafting of severance arrangements (including mediations), recording terms in compromise agreements or via ACAS in a COT3. We provide robust yet pragmatic advice to achieve satisfactory commercial settlements whilst maintaining financial probity. We have close links with DoH and regularly liaise with it or HM Treasury to obtain preliminary guidance for public sector clients. We provide advice about governance matters generally to clients to ensure that any obligations, including audit obligations, or restrictions connected to proposed severance packages are complied with. We have extensive experience of advising clients about senior employee and chief executive terminations, including, in public sector, FOI, DPA and reporting and disclosure considerations. In the private sector we have expertise in boardroom disputes and the company law and regulatory issues for senior executive terminations as well as share and bonus schemes considerations and protecting business interests post termination.
