We have significant experience in advising clients in relation to the impact which restrictive covenants can have on plans to develop property. We are used to advising clients whose land is burdened by restrictive covenants and have recently resolved covenant disputes in both the High Court and the Lands Tribunal. We have also successfully brought injunctive proceedings for clients who enjoyed the benefit of such covenants. In cases of this nature, our experience is that there is very often a commercial compromise to be reached and we have a proven track record of working with our clients to achieve their objectives in that way.
