Bevan Brittan’s specialist Health and Safety Team
provides advice and representation on a wide range of
regulatory law issues covering the whole area of health and
safety; environmental matters; trading standards
prosecutions and the complex area of waste management.
The team acts for a large number of both public and private
sector clients, attending interviews under caution; handling
and assisting on prosecutions as well as intervening and
advising on prohibition and improvement notices. In
particular, the team has a wealth of experience in advising
and assisting clients in the aftermath of workplace
fatalities representing both individuals and organisations
subject to investigation by the police and the health and
safety executive.
The team offers an ‘emergency response’ service to clients,
enabling them, in the event of a major incident, to call
upon specialists who are able to provide immediate and
onsite assistance.
In addition to our ‘reactive’ work, our experience of health
and safety prosecutions provides us with a real insight and
allows us to help clients ‘proactively’ reduce risk in their
business. We can provide training and assist in undertaking
high level reviews of safety policies and ensure solid
processes are put in place to deal with the unexpected.
Just a few examples of work undertaken by the team include:
· Advising a major UK ground contractor following a death of a worker, killed by a piece of plant machinery on a construction site in Rugby. Providing immediate representation when employees were being interviewed by both the police and the HSE and on going representation at the subsequent inquest and prosecution by the HSE.
· Representing and advising a client during police and HSE investigations into a workplace fatality following a fall from lifting equipment. Advising on the prospect of manslaughter charges; appealing enforcement notices and providing representation at the inquest.
· Defending a client being prosecuted by the environment agency for alleged breach of their waste licence.
· Acting for a multi million pound hotel group in the immediate aftermath and HSE investigation into the collapse of a building in central London involving serious injuries to members of the public.
· Drafting and advising on the management of health and safety in the workplace and drafting policies such as stress, joint working, asbestos, legionella and driving at work.
· Providing training on health and safety generally and, in particular, on the implications of the new offence of Corporate Manslaughter coming into force in April 2008.
