We can provide discrete advice upon particular aspects of a project or can handle an entire regeneration project from start to finish, providing an authority or a developer with all necessary legal advice on every aspect of the scheme.
On the property side of regeneration work we deal with all aspects of land assembly, including acting for local authorities and development agencies upon acquiring sites in many ownerships through compulsory purchase. We advise upon joint ventures between public bodies and public and private sector organisations to secure the regeneration of derelict and redundant sites. We can provide advice upon the legal liabilities of contaminated land and how to structure arrangements for its remediation. We advise on planning applications and the planning process.
At the implementation stage we are familiar with the requirements of institutional investors and also advise upon the appointment of the professional team, construction contracts and warranties. From the outset we are always aware of the need for a client to develop an effective exit strategy and we handle the setting up of management companies as well as the disposal of leasehold and freehold interests in the regenerated site.
We also work in other areas of regeneration. We have acted in the creation of urban regeneration companies, including advice to prospective members of such companies. We have specialist knowledge of EU ‘state aid’ issues and have considerable experience of joint working between public sector agencies to secure social regeneration. We have also acted in respective of many innovative private finance schemes, which are essentially regenerative at heart, including local authority education, housing and leisure schemes in England and Wales as well as many NHS LIFT schemes across the country.
