Practice Direction 57AC, which applies to witness statements in the Business and Property Courts after 6 April 2021, has introduced significant changes to the way in which witness evidence is prepared and how it should be presented to Court, with risks for parties (including costs sanctions) for failing to comply.
This seminar provides a practical summary of the practice direction and is aimed at in-house lawyers who have conduct of cases (and therefore at risk of significant sanctions in the event of non-compliance) and/or who are referring cases to external lawyers (and the steps they can take to protect the reliability of witness evidence, before and after referral).
