Monitor, in association with (among others) the Care Quality Commission and the Foundation Trust Governors' Association, has recently published an updated reference guide for NHS foundation trust governors in relation to their statutory duties.

The guide lays out the statutory duties for governors of NHS foundation trusts, as provided by the National Health Service Act 2006 and amended by the Health and Social Care Act 2012. The guide is stated to be advisory only, so governors are not required comply with it (or explain reasons for any non-compliance). Nevertheless, it may prove a useful tool to assist governors in interpreting and complying with their statutory obligations.

The guide may also be of assistance to NHS foundation trust governors as it identifies particular bodies and resources which can support governors in any non-statutory duties they may take on at their NHS foundation trust.
