I am a partner in Bevan Brittan's Commercial and Infrastructure team. I specialise in construction disputes - in particular, I have advised and acted for contractor and owner/employer clients in both the private and public sector in renewable energy (offshore wind and solar), infrastructure (waste, highways and water) and development (including sports stadia) projects.
I have experience of all forms of dispute resolution, including litigation, international arbitration (LCIA, ICC and ad hoc) and ADR (mediation, adjudication and expert determination) and I regularly advise clients on contract management and dispute avoidance.
From a legal practice perspective, I have a keen interest in and considerable experience of electronic disclosure and the use of IT in litigation/arbitration. I am a member of the TeCSA Working Group which developed and has recently updated the E-Disclosure Protocol which was adopted for use in the Technology & Construction Courts. I am also a Member of the Society of Construction Law.
I sit on a number of committees including:
- The Disclosure Working Group, set up by the Chancellor of the High Court to review the civil procedure rules surrounding disclosure
- TECSA e-Disclosure sub-committee
- The International Legal Technology Association Working Group
- The Technology & Construction Court working group
I contribute articles to the Construction Law Journal and I also co-authored the Technology & Construction Court’s E-disclosure Protocol and Guidelines to the Protocol
I regularly lecture and speak at conferences, both in the UK and in Europe on litigation, legal technology and electronic disclosure.
Recently, I gave a talk on offshore commissioning at the University of Dundee.
I have also presented training sessions to the judges of the Technology & Construction Court.
- I led on the case of Walter Lilly v Mackay EWHC 1773, which laid down important guidance in relation to concurrent delay, global claims and the use of formulae in overhead recovery claims.
In my capacity of dealing with Highway Engineering contract administration and commercial matters I have worked with Marie-Claire on Dispute Resolution and Adjudication involving multi million pound disputes. Working with Marie-Claire was a pleasure and a fine example of how the legal and technical professions can work closely together to maximise the benefits to the Client. Marie-Claire is very personable and easy to work with, obviously very knowledgeable, thorough and quickly gets to the nub of the issues, both from the legal perspective and the contractual and technical matters. Those who have been involved in Adjudication will be only too aware of the short timescales allowed for assessing matters and then formulating responses. Marie-Claire worked tirelessly to meet the deadlines which produced a very successful outcome for our Client.
